Recently, Beijing Lung Tin Law Firm received 4 successive winning judgments from Hangzhou Intellectual Property Court of Hangzhou Intermediate People's Court. So far, the right holder represented by Lung Tin has gained notable achievement of victory in a series of litigation cases involving patent and trademark infringement.
In the first half of 2018, one American fitness equipment company, an industry leader, discovered that one Chinese company infringed its patent and trademark on multiple products, so this company entrusted Lung Tin to formulate a comprehensive enforcement strategy and filed a number of patent and trademark infringement lawsuits with competent courts in Shanghai and Hangzhou. Among them, four patent infringement cases were received by the Hangzhou Intellectual Property Court of Hangzhou Intermediate People's Court, and our litigators Mr Siyue Zhang and Ms Li Zheng were appointed to handle the cases. The four cases were formally heard in November 2019. After two days of court hearing, the court finally determined that the alleged infringing products fell within the scopes of protection of all four patent rights, and awarded high damages.
In the cases, our litigators actively cooperated with the investigation team, overcame various difficulties during evidence collection, and successfully preserved multiple evidences of the defendant' s infringement and profit-making, including new evidences urgently preserved before the court session to prove continued infringement and support the damages, which played a positive role in the trial. The litigators in the cases compared the alleged infringing products and the involved patents fully and delicately, and made intuitive and detailed infringement comparison opinions, assisting the judge to better understand the technical points and finally make the infringement determination. In addition, we also organized and submitted extraterritorial evidences that were helpful to the cases, which played a beneficial role in determining infringement and determining damages.
The Hangzhou Intellectual Property Court was established in September 2017. It is an institution attached to the Hangzhou Intermediate People' s Court that specializes in adjudicating intellectual property cases. It has jurisdiction over patents-related technical IP cases in six cities including Hangzhou, Jinhua, Jiaxing, Huzhou, Quzhou, and Lishui.
