On April 21, 2021, Beijing Municipal Bureau of market supervision and Administration announced the Top Ten Typical Cases of IPR Enforcement in 2020. The case of Taiwan Lianhua Food Co., Ltd. suing Beijing Huafei Food Co., Ltd. for infringement of the exclusive right to the registered trademark “Cadina卡迪那” in its production and sales, represented by our firm, was elected.

 

Procedural History:

 

On August 13, 2019, Beijing Fengtai District Market Supervision and Administration Bureau, based on the report of the righter holder, Taiwan Lianhua Food Co., Ltd. that the production and sales of puffed food crispy peas with the logo of “Kadina咔笛娜” by Beijing Huafei Food Co., Ltd. constitutes a similar trademark infringement with the trademark No. 1510095“Cadina卡迪那” registered by Lianhua Food, opened a case to investigate the infringement in accordance with the law.

 

Right after our firm took the case, our team efficiently cooperated with the administrative organization in enforcement actions in the links of food sales and market wholesale, etc., obtaining key evidences including storage receipts, outgoing orders, entrusted producing contracts and commodity inspection and quarantine certificates, etc., to identify the illegal operation amount of Beijing Huafei Food Co., Ltd. totaling more than 1.94 million yuan as of August 13, 2019. Beijing Fengtai District Market Supervision and Administration Bureau imposed an administrative penalty of 7.792 million yuan on Huafei in accordance with the law.
